Federal Agency Extends Proposal Comment Deadline

The Federal Trade Commission (FTC) extended the comment period on a proposed rule to prohibit “junk fees.”

The Trade Regulation Rule on Unfair or Deceptive Fees, which was proposed a year after the FTC’s Motor Vehicle Dealers Trade Regulation Rule, gathers proposals to eliminate “unfair and deceptive charges” across numerous industries. The automotive industry is expected to be exempt from the Trade Regulation Rule after the FTC altered the Motor Vehicle Dealers Trade Regulation Rule to focus on the automotive industry and not other motor vehicle dealers.

The change has heightened focus on the Trade Regulation Rule on Unfair or Deceptive Fees, which may be applied to the other motor vehicle dealers, including the RV industry.

The public comment period on the Trade Regulation Rule on Unfair or Deceptive Fees was originally set to expire Jan. 8, 2024. Now, the FTC extended the comment period to Feb. 7, 2024.

After receiving “several requests” regarding the extension, the FTC said, “the commission has appreciated its ongoing engagement with stakeholders on issues relating to unfair or deceptive fees” and extended the comment period.

Comments can be made online at www.regulations.gov. As of Dec. 27, nearly 50,000 comment letters had been submitted to the FTC.
