Indiana Gov. Mike Braun signed into law RV-specific franchise legislation that governs the RV manufacturer-dealer relations.
The bill will go into effect July 1.
RVIA said passage of the bill was possible thanks to state Sen. Blake Doriot (R-12th District) and state Reps. Doug Miller (R-48), Joanna King (R-49) and Dave Heine (R-85).
The law is based on the RVIA-RVDA Model Manufacturer-Dealer Agreement Bill. The bill establishes a system that more accurately reflects the relationship between RV manufacturers and dealers than other vehicle manufacturer-dealer arrangements.
The law includes language that mandates a written manufacturer-dealer agreement, covers conditions under which manufacturers or dealers can terminate the agreement (including repurchase provisions), outlines transfer or succession of the agreement and establishes warranty provisions. The law also includes sections on pre-delivery inspection, indemnification, mediation and penalties, as well as definitions for all types of RVs.
In January, RVIA Director of State Affairs Michael Ochs testified in support of the bill in the Senate Committee on Homeland Security and Transportation. In March, RVIA Senior Manager of State Affairs Sophie de la Torre also advocated for the bill in the Indiana House Committee on Roads and Transportation.
